If you are a recruitment company and you are sending out spec CVs, you need to make sure that your terms allow you to do that. Now generally speaking, if it’s your agreement you’re using, you’re going to have made sure that you are covering all bases so you can send out a spec CV, you can send out a requested CV, you’re going to be covered. It’s your document, and obviously, you’ve had it professionally checked. The biggest issue is when you receive a contract from your client, and they have said in there, “No spec CVs.” If you send a spec CV, it’s not covered in this agreement, and they will not pay you for anyone that they then hire because they didn’t request it. So you need to make sure that you read your client terms. You don’t just go, “I’ve got a client contract; I’m going to sign it and get some money.” You need to read it and know exactly what you are allowed to do under that contract to make sure that you get paid.
